1. Introduction

Welcome to ICEcard app, an emergency services app designed to help users connect with emergency responders and access critical services during emergencies. By downloading or using ICEcard app, you agree to these Terms and Conditions (“Terms”). Please read them carefully.

2. Definitions

“App” refers to ICEcard app and its associated services.
“User” refers to any individual who downloads, installs, or uses the App.
“Services” refers to the functionalities provided by the App, including but not limited to emergency alerts, location sharing, and communication with emergency responders.

3. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App. The ICEcard app is an emergency support and information system on best efforts basis based on data provided by users and information provided based on available technology and its limitations. Not meeting any users requirement should not be held liable against ICEcard app and firm. 

4. User Responsibilities

Accurate Information: You agree to provide accurate and up-to-date information when creating an account and using the App.
Compliance with Laws: You agree to use the App in compliance with all applicable laws and regulations.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

5. Service Description

Scope of Services: The App provides users with the ability to contact emergency services, share location information, and receive emergency alerts.
Limitations of Services: The App is not a substitute for direct communication with emergency services (e.g., 112). The App may not function properly in all situations, and we do not guarantee that emergency responders will receive or act on information provided through the App.
Availability: The App may be unavailable at times due to maintenance, updates, or other factors beyond our control.

6. User Data and Privacy

Data Collection: The App collects certain personal information, including location data, contact information, and usage data. This information is used to provide and improve the Services.
Data Use: We may share your data with emergency responders and third-party service providers to facilitate the provision of Services. Your data will not be used for marketing purposes without your consent.
Data Security: We implement reasonable security measures to protect your data, but we cannot guarantee complete security.
User Rights: You have the right to access, modify, or delete your personal data. You may also withdraw consent for data collection at any time by contacting our support.

7. Third-Party Services

Integration with Third Parties: The App may integrate with third-party services, such as mapping or emergency response systems. We are not responsible for the performance or availability of these third-party services.
Liability for Third-Party Services: The App provider is not liable for any issues arising from the use of third-party services.

8. Face Scan Related data

1. Collection of Face Scan Data
ICEcard may request access to your device’s camera to collect a face scan for the purpose of [authentication/verification/emergency identification]. When you choose to use this feature, we will collect the following data:

• 3D or 2D representations of your face.
• Biometric information generated from the face scan.
  We only collect face scan data with your explicit consent and in accordance with applicable data privacy laws.

2. Purpose of Face Scan Data
The face scan data collected by ICEcard is used strictly for the following purposes:

• User Authentication: Verifying your identity for secure access to your ICEcard account.
• Emergency Use: Providing First responders, healthcare or law enforcement personnel with vital identification information, if needed in emergencies.
• Account Recovery: Assisting in the recovery of your account in the event you lose access.
  Above are primary uses of face scan data , we do not share this data for marketing, advertising or any unrelated purposes.

3. Storage and Retention
Face scan data is securely encrypted and stored on our servers. The retention period is as follows:

• We retain your face scan data for as long as your ICEcard account is active or until you delete the data.
• Upon account deletion or deactivation, face scan data will be permanently deleted from our servers.

4. Data Sharing and Third-Party Access
We do not sell, rent or trade your face scan data. Your face scan data will only be shared in the following limited scenarios:

• With third-party service providers who assist us with storage, encryption, or processing, and only under strict confidentiality agreements.
• As required by law or in response to valid legal requests (e.g., subpoenas or court orders).
• In cases of emergency, to relevant authorities for identification purposes.

5. Security of Face Scan Data
We implement a variety of security measures to ensure the protection of your face scan data, including:

• Encryption: All face scan data is encrypted both in transit and at rest using industry-standard protocols.
• Access Control: Access to face scan data is restricted to use during any emergency to you, authorized personnel and service providers who have a legitimate need.
• Monitoring: We regularly audit our systems to prevent unauthorized access or data breaches.
  However, no system is completely secure, and we cannot guarantee the absolute security of your face scan data. In the event of a data breach, we will promptly notify affected users and take necessary steps to mitigate damage.

6. User Control and Consent
You have full control over your face scan data. You can:

• Withdraw Consent: You may withdraw your consent for the collection of face scan data at any time through the app settings.
• Delete Face Scan Data: You can request the deletion of your face scan data by contacting customer support or using the data deletion option within the app.
• Access and Review: You may review the face scan data we have stored by submitting a request through our support team.

7. Children’s Privacy
ICEcard does not knowingly collect face scan data from children under the age of 18 without parental consent. Any children data added in app is considered with parent consent and used during any emergency help or need to children.

9. Liability and Disclaimers

No Guarantee of Response: We do not guarantee that emergency services will respond to alerts or that they will respond in a timely manner.
Limitation of Liability: To the maximum extent permitted by law, ICEcard app and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.

10. Termination

User Termination: You may terminate your account at any time by contacting our support.
Provider Termination: We may terminate or suspend your access to the App at any time for any reason, including violations of these Terms.
Effect of Termination: Upon termination, your access to the App will be discontinued, and any data associated with your account may be deleted.

11. Intellectual Property

Ownership: The App and all associated intellectual property, including but not limited to software, trademarks, and content, are owned by eSpace AI Tech Private Limited
User Rights: You are granted a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.

12. Modifications to Terms

Right to Modify: We reserve the right to modify these Terms at any time.
Notification of Changes: We will notify you of any significant changes to these Terms by posting the updated Terms on the App or by other means.
Continued Use: Your continued use of the App after any changes have been made constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of India.
Dispute Resolution: Any disputes arising out of or relating to these Terms will be resolved through mediation, arbitration, or court proceedings in India. The ICEcard app and firm should not be held liable for any limitation in service expected by user.

15. Emergency Use Clause

Emergency Situations: The App should not be solely relied upon in emergency situations. Users should also directly contact emergency services (e.g., 112) when necessary. The efforts from this ICEcard app is to support users in best possible way to help in emergency.
No Emergency Service Guarantee: The App does not replace direct contact with emergency services and may not function properly in all emergency scenarios. The app is build to work on best possible way based on data provided by users and use of technology to meet any emergency needs.

16. Consent

By using the App, you consent to the collection, use, and sharing of your information as described in these Terms and in our Privacy Policy.

17. Miscellaneous

Severability: If any part of these Terms is found to be unenforceable, the remaining Terms will remain in effect.
Entire Agreement: These Terms constitute the entire agreement between you and eSpace AI Tech Private Limited regarding the use of the App.

18. Children’s Privacy

Age Restrictions: The App is not intended for use by individuals under the age of 18. If you are under 18, you may not use the App or using app with parents consent.
