ICEcard Mobile Application

This End User License Agreement (“Agreement”) is between you (“User,” “you,” or “your”) and [LEGAL ENTITY NAME], operating the ICEcard application (“ICEcard,” “App,” “we,” “us,” or “our”).
This Agreement is in addition to our Privacy Policy and Terms and Conditions.
By downloading, installing, accessing, or using the ICEcard App, you agree to be bound by this Agreement. If you do not agree to these terms, you should not download, install, access, or use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the ICEcard App on devices that you own or control.
The App may be used solely for the personal, non-commercial emergency preparedness, emergency information, assistance, communication, and related features made available through the App.
You may not transfer, sublicense, sell, rent, lease, or otherwise provide the App or your license to another person.
ICEcard is a technology platform designed to help users:
Store emergency information;
Manage emergency contacts;
Request assistance from participating emergency service providers available through the ICEcard platform;
Share location information when the user chooses;
Submit certain emergency-related reports and requests.
ICEcard is NOT a substitute for calling official emergency services, including 112, 100, 911, or the applicable official emergency number in your location.
In an immediate or life-threatening emergency, you should contact the appropriate official emergency service directly.
Depending on the permissions you provide and the features you use, the App may use your device’s location for:
Need Help: Sending your coordinates with your request to the emergency service provider you select;
Live Location: Sharing your position with a provider after you accept a live location request;
Reports: Attaching location information to missing-person and luggage reports when you submit them;
Background Updates: Providing location updates while live location sharing is active or where you have granted the appropriate device permissions.
Location availability and accuracy may depend on your device, GPS, network connection, environmental conditions, and other technical factors.
Depending on the actions you take and the features you use, information, including location information, may be visible to:
Emergency service providers registered on the ICEcard platform that you select;
Emergency contacts that you add to the App;
Other users only where a feature explicitly makes information public, such as QR or public profile settings that you control.
Information may also be processed by service providers that operate, host, secure, or support the ICEcard platform as described in our Privacy Policy.
YOU ACKNOWLEDGE AND AGREE THAT:
(a) We do not guarantee that any provider, contact, or authority will receive, read, or act on any alert, request, or location data.
(b) We do not guarantee dispatch of police, ambulance, fire, medical, or other emergency services.
(c) Location information may be inaccurate, delayed, unavailable, or affected by your device, network, GPS availability, environmental conditions, or other factors.
(d) Certain features may be unavailable in particular geographic areas or for certain providers.
(e) In a life-threatening or immediate emergency, you should contact official emergency services directly in addition to, or instead of, using the App.
ICEcard does not operate ambulances, police, fire services, or other official emergency response agencies.
You are responsible for:
Providing accurate information to the App;
Keeping your emergency information up to date;
Keeping your emergency contacts current;
Maintaining appropriate permissions on your device;
Using the App in compliance with applicable laws and regulations;
Using emergency features responsibly.
You must not use the App to submit false emergency requests, deliberately provide misleading information, harass emergency service providers, or misuse emergency-related features.
You must provide accurate registration information when creating or maintaining an ICEcard account.
You are responsible for maintaining the accuracy of information associated with your account.
You may delete your account directly within the ICEcard App by going to:
Profile → General → Delete account
Account deletion is permanent for account access.
Some information may nevertheless be retained where required by law or where retention is necessary for legitimate business records, security, fraud prevention, dispute resolution, or other lawful purposes.
Where the App provides paid features or subscriptions, such features are subject to the applicable app store terms, payment terms, and pricing disclosures presented to you.
Fees are non-refundable except where required by applicable law or expressly stated in our applicable Terms.
Any subscription or payment terms presented at the time of purchase will apply to the relevant transaction.
The ICEcard App, including its software, design, logos, trademarks, graphics, text, content, and other materials provided by us, are owned by us or our licensors and are protected by applicable intellectual property laws.
Except as expressly permitted by this Agreement or applicable law, you may not:
Copy the App or its content;
Modify or create derivative works from the App;
Distribute or commercially exploit the App;
Reverse engineer, decompile, or disassemble the App;
Remove proprietary notices or intellectual property notices.
Nothing in this Agreement transfers ownership of our intellectual property to you.
You may not:
Misuse emergency or location-related features;
Submit false or fraudulent emergency requests;
Harass or abuse emergency service providers or other users;
Interfere with the operation or security of the App;
Scrape, copy, collect, or misuse data from the App;
Use the App for unlawful purposes;
Attempt unauthorized access to our systems;
Attempt unauthorized access to provider accounts or other users’ accounts;
Circumvent security or access controls;
Use the App in a manner that may damage, disable, overburden, or impair the service.
We may take appropriate action where we reasonably believe that the App or its features are being misused.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND EMERGENCY-RELATED FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES INCLUDING WARRANTIES OF:
MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
NON-INFRINGEMENT;
AVAILABILITY;
ACCURACY;
RELIABILITY; AND
UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that:
The App will always be available;
Emergency requests will be successfully delivered;
Any provider or emergency contact will respond;
Location information will always be accurate;
The App will operate without interruption or errors; or
The App will meet every individual emergency or communication requirement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND PARTICIPATING PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, PROPERTY DAMAGE, OR FAILURE TO OBTAIN EMERGENCY ASSISTANCE ARISING FROM OR RELATED TO YOUR USE OF THE APP OR YOUR RELIANCE ON LOCATION, ALERT, OR EMERGENCY FEATURES.
This includes, to the extent permitted by law, circumstances involving:
Failure to receive an alert;
Failure of an emergency contact to respond;
Failure of a participating provider to respond;
Delay in receiving or acting upon an alert;
Inaccurate or unavailable location information;
Network or device failures; or
Unavailability of an App feature or participating provider.
To the maximum extent permitted by applicable law, our total liability shall not exceed the amount you paid us during the twelve (12) months immediately preceding the event giving rise to the claim, or [AMOUNT IN LOCAL CURRENCY], whichever is greater, where such limitation is legally permitted.
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless ICEcard, its affiliates, officers, employees, contractors, service providers, and participating providers from claims, losses, liabilities, damages, costs, and expenses arising from:
Your misuse of the App;
Your violation of this Agreement;
Your violation of applicable laws or regulations;
False or misleading information submitted by you; or
Your unauthorized use of another person’s information or account.
We may suspend or terminate your access to the App or particular features if you breach this Agreement, misuse the App, engage in unlawful activity, or otherwise create a security or operational risk.
You may stop using the App at any time.
You may also delete your account through:
Profile → General → Delete account
Termination or account deletion does not necessarily require us to delete information that we are legally required or otherwise permitted to retain.
We may update or modify this Agreement from time to time to reflect changes to the App, our services, legal requirements, or business practices.
Material changes may be communicated through the App or our website.
The updated Agreement will include a revised “Last Updated” date.
Where permitted by applicable law, your continued use of the App after the updated Agreement becomes effective constitutes acceptance of the revised Agreement.
If you do not agree with the updated Agreement, you should stop using the App.
This Agreement is governed by the laws of India, without regard to its conflict-of-law rules.
The courts at [City, State] shall have exclusive jurisdiction over disputes arising out of or relating to this Agreement, subject to any mandatory consumer protections or other rights that cannot be excluded under applicable law.
